1.     Controller and data protection officer

The following Data Protection Policy provides information on the principles by which TRACOE medical GmbH handles your data, i.e., the manner, scope and purpose of collecting and using personal data by this website https://www.tracoe.com/.

We take protecting your data very seriously and handle your personal data at all times confidentially and in conformance with legal requirements. Because of new technologies and continuous development of this website, changes may be made to this Data Protection Policy and we therefore recommend visiting our Data Protection Policy at regular intervals.

2.    Rights of data subjects

You can claim your data protection rights at any time and without charge. Our data protection officer individually reviews and responds to each case. You can find his contact information in item 1.2.

2.1    Right of access, GDPR Art. 15

You have the right to be told free of charge at any time whether we process personal information concerning you.

2.2    Right of rectification (GDPR Art. 16), erasure (GDPR Art. 17), restriction of processing (GDPR Art. 18), data transmission (GDPR Art. 20) and the right to object (GDPR Art. 21)

Furthermore, it is possible for you to assert the rights of rectification, erasure or restriction of processing. You can also file an objection to the processing of your data with us at any time.

2.3    Withdrawal of consent (GDPR Art. 7 [3])

If you have provided your personal data on the basis of consent, you have the right to withdraw the consent for the future at any time. Please note that the withdrawal of consent does not affect the lawfulness of processing that occurred on the basis of the consent up to the time of withdrawal.

2.4    Your right to file a complaint with the supervisory authority

3.    Processing your data while using this website

3.1    No logging

When using the website merely for information purposes, i.e., if you do not register or transmit other information, we merely collect the following data so that we can transmit the website to your computer:

•    IP address
•    Date and time of query
•    Time zone difference to Greenwich Mean Time
•    Content of the request (concrete page)
•    Access status/HTTP status code
•    Quantity of data transmitted
•    Website originating the request
•    Browser, interface, language and browser software version

In this case the data are not stored in a server log file.

4.    General part of the Data Protection Policy

4.1    Cookies

4.1.1    Definition: transient vs. persistent cookies

When you contact us by E-mail or through a contact form, the data you provide (your E-mail address and possibly your name and telephone number) will be stored by us so that we can answer your questions. All information you provide is voluntary. It is possible to write a message without providing personal data. If you wish to receive a reply, you must provide your E-mail address. The legal basis for processing the contact inquiry and managing it is GDPR Art. 6 I (b) in case of a pre-contractual or existing contractual relationship, or GDPR Art. 6 I (f) in case of other inquiries.

The information you provide is stored on the basis of consent pursuant to GDPR Art. 6 I (a). We delete the data collected in this context once it is no longer necessary to store it and there are no legal storage requirements impeding its erasure (e.g., in case of subsequent contract management).

Since you have given consent, we wish to notify you that you can withdraw the consent you gave at the time of your contact inquiry at any time, effective for the future (GDPR Art. 7 III). Please contact us if you wish to exercise this withdrawal possibility.

Your personal data are encrypted during transmission using TLS technology to prevent unauthorised access by third parties.

5.    Social media, social plug-ins, third-party content

5.1    Google Maps

We use content from Google Maps on our website to indicate our location and provide driving directions. This is a service provided by Google Ireland Limited, a company registered and operated under Irish law (registration number 368047) with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

This service allows us to show you interactive maps directly on the website and makes it possible for you to conveniently use the mapping function.

By certification under the EU-US Privacy Shield Framework (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active), Google guarantees that the European Union’s data protection requirements are met when processing data in the US.

By visiting the website Google receives the information that you requested the corresponding page from our website. If you use the integrated “Google Maps” function, Google stores a cookie on your device through your browser. Your user settings and data are processed in order to display our location and create driving directions. It cannot be ruled out that Google will use servers in the US for this purpose. The following data are transmitted:

Such analysis is used (even for users who are not logged in) particularly to provide needs-based advertising and to notify other users of the social network of your activities on our website. You have the right to object to the creation of these user profiles; you must contact Google to exercise this right.

The legal basis for this is GDPR Art. 6 I (f). Our justified interest is in optimising the functionality of our website.

5.2    Pure linking to the social media websites

The Facebook, YouTube link integrated into our site is not integrated through a social plug-in. The integrated graphic merely contains an HTTP link to our Facebook, YouTube page. Accordingly, no direct connection is established to the servers of the aforementioned sites when requesting our site.

5.3    YouTube integration

We have integrated YouTube videos in our online content that are stored at www.youtube.com and can be played directly from our website. The data named below are transmitted only if you play the videos. We have no control over this data transmission.

By visiting the website, YouTube is notified that you requested the corresponding page of our website. Also transmitted are the IP address, the date and time of the query, the time zone difference to Greenwich Mean Time, the content of the request (specific page), access status/HTTP status code, the quantity of data transmitted, the website where the request originated, browser, operating system and its interface and language and browser software version. This occurs regardless of whether YouTube provides a user account where you are logged in or whether or not there is a user account. If you are logged into Google your data are associated directly with your account. If you do not want the association with your YouTube profile, you must log out before activating the button. YouTube stores your data as use profiles and uses them for advertising and market research purposes and/or for designing its website to suit user needs. Such analysis is used (even for users who are not logged in) particularly to provide needs-based advertising and to notify other users of the social network of your activities on our website. Through the YouTube integration, you as a user have the ability to call up videos and use YouTube’s functions. Our purpose as vendor is to improve our content by this. The legal basis for processing personal data is GDPR Art. 6 I 1 (f).

5.4    For web analysis we use

5.4.1    Google Analytics

On this website we use Google Analytics, which helps analyse user behaviour on our website. This is a service provided by Google Ireland Limited, a company registered and operated under Irish law (registration number 368047) with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

By certification under the EU-US Privacy Shield Framework (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active), Google guarantees that the European Union’s data protection requirements are met when processing data in the US.

Use- and user-related information is transmitted to a Google server in the US and stored, particularly the IP address, location, time or frequency of visits to our website. The anonymising function is also used as part of Google Analytics, which truncates the IP address even within the EU and EEA.

The data collected in this way are used by Google to provide us with an analysis of visits to our website and of use activities.

The legal basis for using Google Analytics is found in GDPR Art. 6 I (f). We see the justified interest in the analysis, optimisation and operation of our website.

Finally, Google indicates that it does not combine your IP address with other data. Google provides additional data protection information in this regard, which you can retrieve at google.com/intl/de/policies/privacy/partners. Furthermore, Google provides a deactivation add-on that can be installed in common Internet browsers. The link to the deactivation add-on can be found here: tools.google.com/dlpage/gaoptout. This add-on ensures that the information on the visit to our website is not transmitted to Google Analytics.

6.    Outside service providers

We use the services of a service provider specialising in web hosting to operate our web content, and are supported by an advertising agency to maintain the site. On request we will provide you with a detailed summary of the service providers we use. No data are shared with other service providers.
